Terms of Service

Article 1 (Application)

These Terms of Service (the "Terms") apply to all relationships concerning the use of LOCATE (the "Service") between the operator of the Service (the "Operator") and any person who uses the Service (the "User").

Article 2 (Definitions)

  1. "Service" means the multilingual AI travel guidebook generation service provided by the Operator (offered at belocate.app and other domains designated by the Operator).
  2. "Points" means a unit representing the right to receive the guidebook-generation service (a usage right). Points are not money, currency, or a prepaid payment instrument, and cannot be exchanged for cash, refunded, or transferred to third parties.
  3. "Free use" means using the Service within the scope and number of times set by the Operator, without account registration or the purchase of Points.

Article 3 (Account Registration and Management)

  1. A User may register an account by the method designated by the Operator and purchase Points to use the paid features of the Service.
  2. If registration information is false, the Operator may refuse the registration or suspend the account.
  3. A User shall manage their authentication credentials at their own responsibility and shall not allow any third party to use them, nor lend or transfer them.
  4. A minor using the Service shall do so with the consent of a parent or other legal guardian.

Article 4 (Fees and Payment)

  1. Fees for paid features are as displayed on each purchase page (in US dollars, tax included).
  2. The payment method is credit card payment (Stripe) only. Payment is made immediately at the time of purchase in accordance with the rules established by Stripe.

Article 5 (Validity and Expiry of Points)

  1. The validity period of purchased Points is 90 days (including the time of day) from the date and time the purchase is completed.
  2. Points not consumed within the validity period automatically lapse upon expiry, and the User may not use them thereafter.
  3. Even if a User purchases additional Points, the validity period of other Points already held shall not be extended; each purchase is subject to its own 90-day validity period from the date and time the purchase is completed.

Article 6 (No Refunds or Cancellation)

  1. Because the service (usage right) is provided immediately upon completion of purchase, no cancellation, return, refund, or exchange for cash is accepted after purchase, regardless of the reason.
  2. Even if a User is subject to measures under Article 9 or voluntarily withdraws, no refund of fees already paid and no compensation for remaining Points will be provided.

Article 7 (Disclaimer Regarding AI-Generated Content)

  1. The guidebooks and other content generated by the Service are produced automatically by AI and may contain errors, outdated information, or information that does not exist regarding places, facilities, business hours, prices, transportation, or other matters.
  2. The Operator makes no warranty as to the accuracy, currency, completeness, real existence, or fitness for a particular purpose of the generated content. Users shall verify the content at their own responsibility when using the generated information.
  3. Map links provided by the Service are for informational purposes only and do not guarantee the accuracy of routes, locations, or the like.

Article 8 (Prohibited Acts)

Users shall not engage in any of the following acts when using the Service:

  1. Allowing a third party to use their account, or sharing an account among multiple persons;
  2. Lending, transferring, selling, or changing the name on an account or Points;
  3. Placing an excessive load on the servers or network of the Service;
  4. Improperly obtaining the Service's data, or operating it automatically, by means of scraping, crawlers, or other automated means;
  5. Reverse engineering, decompiling, or disassembling the Service's software;
  6. Using the Service with another person's credit card or a fraudulently obtained credit card;
  7. Using the Service for commercial or resale purposes without the Operator's prior consent;
  8. Acts that violate laws or public order and morals, or other acts the Operator deems inappropriate.

Article 9 (Suspension and Cancellation of Registration)

  1. If the Operator determines that a User has violated the preceding article, the Operator may suspend the account or cancel the registration without prior notice.
  2. In such a case, the Operator will not refund fees already paid or compensate for remaining Points. If the Operator suffers damage as a result, the Operator may claim compensation from the User.

Article 10 (Changes, Interruption, and Termination of the Service)

  1. The Operator may temporarily suspend all or part of the Service for maintenance or inspection, with prior notice (or with prompt notice afterward in an emergency).
  2. The Operator shall not be liable where the Service cannot be provided due to failure of communication lines, trouble at the server provider, natural disaster, or other causes not attributable to the Operator.
  3. The Operator may terminate the Service by giving Users notice with a reasonable advance period.

Article 11 (Disclaimer and Limitation of Liability)

  1. The Operator shall not be liable for any damage to Users arising from the preceding article or other causes not attributable to the Operator.
  2. Even where the Operator is liable to a User for damages (except in cases of the Operator's intent or gross negligence), the amount of compensation shall be limited to the amount of the purchase that caused the damage.

Article 12 (Handling of Personal Information)

Users' personal information is handled in accordance with the separately established Privacy Policy.

Article 13 (Changes to These Terms)

The Operator may change these Terms when it deems necessary. The revised Terms take effect when posted on the Service.

Article 14 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. Any dispute arising between the Operator and a User in connection with the Service shall be subject to the exclusive agreed jurisdiction of the Nagoya District Court as the court of first instance.

利用規約

第1条（適用）

本利用規約（以下「本規約」）は、LOCATE（以下「本サービス」）の運営者（以下「運営者」）と、本サービスを利用する者（以下「ユーザー」）との間の一切の利用関係に適用されます。

第2条（定義）

  1. 「本サービス」とは、運営者が提供する、AIを用いた多言語旅行ガイドブック生成サービス（belocate.app その他運営者が定めるドメインで提供されるもの）をいいます。
  2. 「ポイント」とは、本サービスにおいてガイドブックを生成する役務の提供を受ける権利（利用権）を表す単位をいいます。ポイントは金銭・通貨・前払式支払手段ではなく、換金・払戻し・第三者への譲渡はできません。
  3. 「無料利用」とは、アカウント登録およびポイント購入を要せず、運営者が定める範囲・回数で本サービスを利用することをいいます。

第3条（アカウント登録・管理）

  1. ユーザーは、運営者の定める方法によりアカウントを登録のうえ、ポイントを購入して本サービスの有料機能を利用できます。
  2. 登録情報に虚偽があった場合、運営者は登録を拒否し、またはアカウントを停止できます。
  3. ユーザーは、自己の認証情報を自己の責任で管理するものとし、第三者に利用させ、または貸与・譲渡してはなりません。
  4. 未成年者が本サービスを利用する場合は、親権者その他の法定代理人の同意を得たうえで利用するものとします。

第4条（利用料金および支払方法）

  1. 有料機能の利用料金は、各購入ページに表示する価格（米ドル建て・税込）によります。
  2. 支払方法はクレジットカード決済（Stripe）のみとします。決済はStripe社の定めるところに従い、購入手続き時に即時に行われます。

第5条（ポイントの有効期限・失効）

  1. ユーザーが購入したポイントの有効期限は、購入手続きが完了した日時から90日間（時刻を含む）とします。
  2. 有効期限内に消費されなかったポイントは、期限の到来をもって自動的に失効するものとし、ユーザーは以後これを利用できません。
  3. ユーザーがポイントを追加購入した場合であっても、既に保有する他のポイントの有効期限は延長されないものとし、各購入ごとに、それぞれ購入手続きが完了した日時から90日間の有効期限が個別に適用されます。

第6条（返金・キャンセルの不可）

  1. 本サービスは、購入手続き完了後ただちに役務（利用権）が提供される性質上、理由のいかんを問わず、購入後のキャンセル・返品・返金・換金には一切応じられません。
  2. ユーザーが第9条に基づく処分を受けた場合、または自ら退会した場合であっても、既に支払われた料金の返金、および残存ポイントの補償は行いません。

第7条（AI生成コンテンツに関する免責）

  1. 本サービスが生成するガイドブックその他のコンテンツは、AIにより自動生成されるものであり、店舗・施設・営業時間・料金・交通その他の情報について、誤り、古い情報、または実在しない情報を含む可能性があります。
  2. 運営者は、生成されるコンテンツの正確性・最新性・完全性・実在性・特定目的への適合性について、いかなる保証も行いません。ユーザーは、生成された情報を利用するにあたり、自己の責任で内容を確認するものとします。
  3. 本サービスが提供する地図リンクは情報提供を目的とするものであり、経路・所在地等の正確性を保証しません。

第8条（禁止事項）

ユーザーは、本サービスの利用にあたり、以下の行為をしてはなりません。

  1. 自己のアカウントを第三者に利用させ、または複数人で共有して利用する行為
  2. アカウントまたはポイントを貸与・譲渡・売買・名義変更する行為
  3. 本サービスのサーバーやネットワークに過度の負荷をかける行為
  4. スクレイピング・クローラー等の自動的手段により本サービスのデータを不正に取得し、または自動操作する行為
  5. 本サービスのソフトウェアをリバースエンジニアリング・逆コンパイル・逆アセンブルする行為
  6. 他人のクレジットカード、または不正に取得したクレジットカードを用いて本サービスを利用する行為
  7. 運営者の事前の承諾なく、本サービスを商業目的・転売目的で利用する行為
  8. 法令または公序良俗に違反する行為、その他運営者が不適切と判断する行為

第9条（利用停止・登録抹消）

  1. 運営者は、ユーザーが前条に違反したと判断した場合、事前の通知なく、当該ユーザーのアカウントの利用停止または登録抹消を行うことができます。
  2. 前項の場合において、運営者は、既に支払われた料金の返金および残存ポイントの補償を行いません。また、これにより運営者に損害が生じた場合、運営者は当該ユーザーに損害賠償を請求できます。

第10条（本サービスの変更・中断・終了）

  1. 運営者は、システムの保守・点検を行う場合、事前に（緊急時は事後速やかに）通知のうえ、本サービスの全部または一部を一時的に停止できます。
  2. 運営者は、通信回線の障害、サーバー提供企業のトラブル、天災地変その他運営者の責めに帰さない事由により本サービスを提供できない場合、その責任を負いません。
  3. 運営者は、相当の予告期間をもってユーザーに通知することにより、本サービスを終了できます。

第11条（免責・損害賠償の制限）

  1. 運営者は、前条その他運営者の責めに帰さない事由により生じたユーザーの損害について、一切の責任を負いません。
  2. 運営者がユーザーに対して損害賠償責任を負う場合であっても（運営者に故意または重大な過失がある場合を除きます）、その賠償額は、当該損害の原因となった購入の代金額を上限とします。

第12条（個人情報の取扱い）

ユーザーの個人情報は、別途定める「プライバシーポリシー」に従って取り扱います。

第13条（本規約の変更）

運営者は、必要と判断した場合、本規約を変更できます。変更後の規約は、本サービス上に掲示した時点から効力を生じます。

第14条（準拠法・管轄）

  1. 本規約の準拠法は日本法とします。
  2. 本サービスに関して運営者とユーザーとの間に生じた紛争については、名古屋地方裁判所を第一審の専属的合意管轄裁判所とします。
